BADUNG, OborDewata.com – The Government of Badung Regency, along with the Civil Service Police Unit (Satuan Polisi Pamong Praja – Satpol PP), is taking a swift action against a construction project that exceeded the boundaries of its Freehold Certificate (Sertifikat Hak Milik – SHM) and encroached upon a local river body.
A firm recommendation for demolition has been prepared as a decisive measure to restore the river’s condition to its original state.
I Gusti Lanang Umbara, the Deputy Chairperson of Commission I of the Local People’s Representative Council of Badung Regency (DPRD Badung), stated that this violation cannot be tolerated as it has the potential to worsen the risk of flooding in the area of Badung Regency.
“Our Civil Service Police Unit (Satpol PP) in Badung Regency has followed up on the construction that violated its Freehold Certificate (SHM), leading to the encroachment on our river body here. A firm recommendation for demolition must be carried out; the state of the river must be returned to its original condition before the building existed,” he explained on Tuesday (7/10/2025) in Badung.
He confirmed that the Civil Service Police Unit (Satpol PP) has followed Standard Operating Procedures (SOP), beginning with issuing the first up to the third warning letters. Throughout this process, the government has been waiting for the building owner’s good faith to carry out the demolition independently.
However, if the developer fails to act, the Local People’s Representative Council of Badung Regency (DPRD Badung) and the Local Government will recommend a tougher measure: forced demolition and the freezing of business permits.
“The deadline follows the SOP usually implemented by our Civil Service Police Unit (Satpol PP), which is after the first, second and third warnings. These warnings are given while we await their good faith, as communicated to the owner’s legal counsel. While following the SOP, we are urging them to carry out the demolition independently, meaning they independently address the structure that violates their Freehold Certificate (SHM) and even encroached on the river body. If they fail to do so, the Local Government and the Local People’s Representative Council (DPRD Badung) will recommend taking firm action to carry out the demolition and temporarily freeze the permits they hold. The permit they have is only a temporary Business Identification Number (Nomor Induk Berusaha – NIB). Other permits have yet to be issued because they are non-compliant, thus they have yet to be released by the Public Works and Spatial Planning Agency (Pekerjaan Umum dan Perumahan Rakyat – PUPR) and the Investment and One-Stop Integrated Service Agency (Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu – DPMPTSP),” he elaborated.
He stressed that this effort to enforce the Local Regulation (Perda) is part of the Local Government’s strategy for disaster mitigation, especially concerning the frequent flooding caused by land-use conversion and zoning violations.
“It is very important for us to do this because we are focused on tackling natural disasters related to flooding, given the recent experience of a very large flood in Bali. That is why we are focusing on implementing measures for flood disaster mitigation, so it does not happen again in the future. This includes the firm action we are taking today, the strict enforcement of the local regulation regarding the protection of our rivers in Badung Regency,” he concluded. mas/pril
